1. About Backstage.cam

1.1 Backstage.cam ("Backstage", "we", "us", or the "Platform") is a digital content platform that curates, licenses, and makes available digital media content from third-party creators. Backstage offers users access to such content through subscriptions and pay-per-view purchases.

1.2 Backstage.cam is operated by Wild SARL, a company registered in Luxembourg (registration number B232882), with its registered office at 10A rue des Mérovingiens, 8070 Bertrange, LUXEMBOURG.

1.3 Backstage.cam acquires or licenses rights to digital content from creators and provides access to such content through its platform.

1.4 Backstage.cam is a curated digital content platform. All content made available on the Platform is sourced, selected, and approved by Backstage.cam in accordance with its editorial standards and applicable legal and regulatory requirements. Content that does not meet these standards, including adult or sexually explicit material, is not accepted or distributed.

2. Acceptance of These Terms

2.1 These Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy and any other policies referenced herein (collectively, the "Policies"), govern your access to and use of the Platform.

2.2 By accessing, registering for, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Policies.

2.3 If you do not agree to these Terms, you must not access or use the Platform.

2.4 These Terms constitute a legally binding agreement between you and Wild SARL.

3. Eligibility, Age, and Identity Verification

3.1 Eligibility. You must be legally capable of entering into binding agreements under the laws of your jurisdiction to access or use the Platform.

3.2 Minimum Age. The Platform may be accessed by individuals aged 13 to 17 only with the consent and supervision of a parent or legal guardian.

Features involving payments, subscriptions, or financial transactions are strictly limited to individuals aged 18 years or older.

3.3 Independent Content Providers and Commercial Counterparties. Individuals or entities that enter into commercial contractual arrangements with Backstage.cam to provide licensed content, promotional services, or related marketing services ("Content Providers") must complete a verification and onboarding process prior to providing any such content or services. This process is mandatory and may include:

(a) Identity Verification: Submission of valid, unexpired government-issued photo identification (e.g., passport, national ID, or driver's license);

(b) Age Verification: Confirmation that the individual is at least 18 years of age;

(c) Biometric Verification: Liveness or facial verification checks designed to prevent identity fraud, impersonation, or the use of manipulated or synthetic media;

(d) AML and Sanctions Screening: Screening against applicable global watchlists and compliance databases, including but not limited to sanctions lists (e.g., OFAC, UN, EU, HMT), politically exposed persons (PEP) databases, and adverse media sources;

(e) Third-Party Verification Providers: Use of secure, accredited third-party identity and compliance service providers.

Backstage.cam reserves the right to determine the scope and extent of verification required based on risk, regulatory requirements, and payment processor obligations.

3.4 Record-Keeping and Compliance. Backstage.cam maintains records of identity verification, onboarding, and compliance checks in accordance with applicable laws, regulatory requirements, and payment processor obligations. Content Providers consent to the retention of such records for the period required by law or contractual obligations.

3.5 Additional Information and Ongoing Verification. Backstage.cam reserves the right, at its sole discretion, to:

(a) request additional identity, tax, or banking information;

(b) conduct re-verification at any time;

(c) apply enhanced due diligence measures for higher-risk profiles or activities;

(d) suspend or terminate relationships pending completion of verification or compliance checks;

(e) refuse to onboard or continue any contractual relationship with any individual or entity that does not meet applicable requirements.

3.6 Non-Compliance. If Backstage.cam determines that any individual does not meet applicable eligibility, age, or compliance requirements, we may immediately suspend or terminate access to the Platform or any related services, and take any additional action required by law, regulation, or payment processor obligations.

3.7 Ongoing Monitoring. Backstage.cam conducts ongoing monitoring of platform activity and business relationships for the purposes of fraud prevention, regulatory compliance, and risk management. This may include periodic re-verification and review of activity patterns.

3.8 Cooperation. Content Providers and other relevant users agree to cooperate fully with reasonable requests from Backstage.cam or its payment processing partners in connection with identity verification, compliance reviews, fraud prevention, and regulatory obligations.

4. Changes and Electronic Communications

4.1 We may modify these Terms at any time at our sole discretion. For material changes, we will provide at least 15 days' prior notice via email or prominent notice on the Platform before such changes take effect, except where changes are required by law or relate to new features.

4.2 Continued use of the Platform after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform before the changes take effect.

4.3 By using the Platform, you consent to receive communications from us electronically, including notices regarding your account, transactions, and changes to our Terms or Policies. Such communications satisfy any legal requirement for written notice.

5. Account Registration and Security

5.1 You must provide accurate, current, and complete information when creating an account and keep such information up to date. Providing false, misleading, or fraudulent information is grounds for immediate account termination.

5.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. You must notify us immediately of any unauthorized access or security breach.

5.3 Accounts are personal and non-transferable. You may not sell, rent, sublicense, share, or allow third-party access to your account.

5.4 You may maintain only one account. Creating multiple accounts to circumvent restrictions, bans, or for fraudulent purposes is strictly prohibited.

5.5 For users under the age of 18, a parent or legal guardian must consent to and supervise the use of the account and is responsible for all activity conducted through it.

5.6 We reserve the right to suspend or disable any account, username, or identifier at our discretion, including for violations of these Terms, the Policies, or applicable law.

6. Platform Functionality and Content Control

6.1 Platform Functionality. The Platform enables users to:

(a) create and manage personal accounts;

(b) access and view digital content made available by Backstage.cam;

(c) purchase subscription-based or pay-per-view access to such content;

(d) interact with Platform features, including messaging functionalities where available.

6.2 Content Sourcing and Control. All content made available on the Platform is sourced from approved Content Providers under separate commercial agreements with Wild SARL or its affiliated entities.

6.3 Content Selection and Editorial Standards. Backstage.cam operates a controlled content selection process. Content is only made available where it complies with Backstage.cam's editorial standards, as well as applicable legal, regulatory, and payment processor requirements.

6.4 Content Availability. Backstage.cam may modify, remove, or restrict access to content where necessary to comply with applicable laws, regulations, or payment processor requirements.

7. Subscriptions, Pay-Per-View Content, and Purchases

7.1 Sale of Digital Content. Backstage.cam offers subscription-based and pay-per-view access to digital content made available on the Platform.

All purchases are made directly from Backstage.cam. Backstage.cam is the seller of record for all transactions conducted on the Platform.

7.2 Nature of the Service. Subscriptions and pay-per-view purchases provide users with access to digital content made available through the Platform.

Access is granted for the applicable subscription period or on a per-content basis, as indicated at the time of purchase.

7.3 Content Availability. Backstage.cam determines, at its sole discretion, the content made available on the Platform and does not guarantee the continued availability of any specific content.

7.4 Subscription Terms.

(a) Subscriptions are billed on a recurring basis (e.g., monthly) unless cancelled prior to the renewal date.

(b) By subscribing, you authorize Backstage.cam to charge your selected payment method for each billing period until cancellation.

(c) Subscription fees are charged in advance at the beginning of each billing period.

(d) You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

7.5 Digital Content Delivery. Digital content is made available immediately upon purchase or activation of a subscription, unless otherwise specified.

8. Payments, Subscriptions, and Financial Terms

8.1 Payment Processing. Payments on the Platform are processed by third-party payment service providers in accordance with applicable security and compliance standards. Backstage.cam does not store full payment card or bank account details.

Backstage.cam may change payment service providers at any time to comply with legal, regulatory, or operational requirements.

8.2 Accepted Payment Methods. Backstage.cam accepts the payment methods displayed at the time of purchase. Available payment methods may be modified at any time.

8.3 Pricing and Billing. All prices are displayed at the time of purchase and may include applicable taxes, fees, or currency adjustments where required by law.

By completing a purchase, you authorize Backstage.cam to charge your selected payment method for the applicable amount.

Backstage.cam is the seller of record for all transactions conducted on the Platform.

Backstage.cam may adjust pricing where necessary to reflect applicable taxes, currency fluctuations, or legal requirements.

8.4 Subscriptions and Auto-Renewal.

(a) Subscriptions are billed on a recurring basis (e.g., monthly) unless cancelled prior to the renewal date.

(b) By subscribing, you authorize Backstage.cam to automatically charge your payment method at the start of each billing period.

(c) Subscription fees are billed in advance.

(d) You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

8.5 Digital Content and Delivery. Purchases made on the Platform provide access to digital content. Access is granted immediately upon purchase or subscription activation, unless otherwise specified.

8.6 Refunds and Right of Withdrawal.

(a) Statutory Rights (EU / EEA / UK Users). If you are a consumer resident in the European Union, European Economic Area, or United Kingdom, you may have a statutory right to withdraw from a purchase within fourteen (14) days without giving any reason.

However, by purchasing digital content or a subscription, you expressly request immediate access to such content and acknowledge that you thereby lose your right of withdrawal once access is provided, in accordance with applicable consumer protection laws.

By completing a purchase, you confirm:

"I consent to immediate access to the digital content and acknowledge that I thereby lose my right of withdrawal."

(b) Users Outside the EU / EEA / UK. For users outside the European Union, European Economic Area, and United Kingdom, purchases of digital content are final and non-refundable, except where required by applicable law or expressly stated otherwise in these Terms.

(c) Discretionary Refunds. Backstage.cam aims to provide a high level of customer satisfaction and may, at its sole discretion, provide refunds or credits in appropriate circumstances, including technical issues, billing errors, or other legitimate concerns.

Users are encouraged to contact Backstage.cam support to resolve any issue before initiating a chargeback or payment dispute, as most concerns can be addressed quickly through customer support.

(d) Refund Method. Any approved refund will be issued to the original payment method, unless otherwise required by law.

8.7 Chargebacks and Disputes. Backstage.cam reserves the right to investigate and respond to any chargeback, dispute, or reversal initiated through a payment provider or financial institution.

8.8 Fraud Prevention and Transaction Monitoring. Backstage.cam may monitor transactions and account activity for fraud prevention, compliance, and risk management purposes.

We reserve the right to decline, delay, suspend, or cancel transactions where necessary to comply with applicable laws, regulations, or payment processor requirements.

8.9 Billing Descriptor. Transactions may appear on your payment statement as "Backstage.cam" or a similar descriptor.

8.10 Payment Compliance. Use of the Platform is subject to applicable payment network rules, financial regulations, and payment processor requirements. Where such requirements impose stricter obligations than these Terms, those requirements shall prevail.

9. Prohibited Conduct and Payment Misuse

9.1 General Rule. You may not use the Platform in any manner that is unlawful, fraudulent, or intended to abuse the Platform or its payment system.

9.2 Circumvention of Platform Systems. You may not attempt to bypass, circumvent, or interfere with the Platform's systems, including payment systems, subscription mechanisms, or access controls.

This includes attempting to bypass access controls, subscription mechanisms, or other security features in order to access content without authorization.

9.3 Payment Fraud and Abuse. You may not:

(a) use stolen, unauthorized, or third-party payment methods without proper authorization;

(b) engage in fraudulent chargebacks or dispute abuse;

(c) attempt to test, probe, or validate payment credentials;

(d) create or use multiple accounts to evade restrictions, bans, or security measures.

9.4 Unauthorized Use of Content or Services. You may not access, distribute, reproduce, or use content from the Platform in any manner that is unauthorized, unlawful, or in violation of these Terms.

9.5 Illegal or Prohibited Activities. You may not use the Platform in connection with any unlawful activity or to engage in conduct that violates applicable laws or regulations.

This includes any misuse of the Platform's services, content, or communication features for illegal purposes.

9.6 Monitoring and Enforcement. Backstage.cam may monitor activity on the Platform for the purposes of fraud prevention, security, and compliance.

Violations of this Section may result in suspension or termination of your account, restriction of access, cancellation of transactions, or other actions as necessary to protect the Platform and its users.

Backstage.cam may also report suspected unlawful activity to relevant authorities or payment service providers where required.

10. Sanctions and Geographic Restrictions

10.1 OFAC and Sanctions Compliance. Backstage.cam complies with economic sanctions administered by the U.S. Office of Foreign Assets Control (OFAC), the European Union, and other applicable sanctions regimes. You represent and warrant that you are not:

(a) located in, organized under the laws of, or a resident of any country or territory subject to comprehensive sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions);

(b) identified on any sanctions list, including the OFAC Specially Designated Nationals (SDN) List, EU Consolidated List, or UN Security Council sanctions lists;

(c) owned or controlled by any sanctioned person or entity.

10.2 Geographic Availability. The Platform may not be available in all jurisdictions. We reserve the right to restrict access from certain countries or regions based on legal, regulatory, or risk considerations.

11. Intellectual Property and Content Rights

11.1 Ownership of Platform Content. All content made available on the Platform, including without limitation digital media, text, graphics, and other materials, is owned by or licensed to Backstage.cam.

Such content is protected by applicable intellectual property laws, including copyright, trademark, and related rights.

11.2 Limited License to Users. Subject to compliance with these Terms, Backstage.cam grants users a limited, non-exclusive, non-transferable, non-sublicensable license to access and view content solely for personal, non-commercial use through the Platform.

Users do not acquire any ownership or proprietary rights in the content.

11.3 Restrictions on Use. Users may not, without prior written authorization from Backstage.cam:

(a) reproduce, distribute, modify, or create derivative works from any content;

(b) publicly display, perform, or transmit content outside the Platform;

(c) sell, license, or otherwise exploit content for commercial purposes;

(d) attempt to download, copy, or extract content by unauthorized means.

11.4 Trademarks and Platform Materials. The Backstage.cam name, logo, and all related branding, as well as the design and functionality of the Platform, are the property of Backstage.cam or its licensors and may not be used without prior written consent.

11.5 Intellectual Property Complaints. Backstage.cam respects intellectual property rights and takes allegations of infringement seriously.

If you believe that any content available on the Platform infringes your rights, you may contact us at dmca@backstage.cam with sufficient information to identify the content and describe your claim.

Backstage.cam will review such notices and take appropriate action where required in accordance with applicable laws.

11.6 Enforcement. Backstage.cam reserves the right to remove or restrict access to content that is alleged to infringe intellectual property rights and to take any action required to comply with applicable law.

12. Privacy and Data Protection

12.1 Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

12.2 By using the Platform, you consent to the collection, processing, and transfer of your data as described in our Privacy Policy.

12.3 We may share user data with law enforcement, regulators, or other authorities when required by law or to protect the safety of our users or the public.

13. Third-Party Services and Links

13.1 The Platform may contain links to or integrations with third-party services, including payment processors, identity verification providers, and analytics services.

13.2 Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party content, practices, or availability.

13.3 Third-party payment processors may have additional terms that apply to transactions.

14. Account Suspension and Termination

14.1 Termination by You. You may close your account at any time through your account settings or by contacting support. Account closure does not affect obligations incurred prior to closure and does not automatically entitle you to refunds for prepaid subscription periods, except where required by law or expressly stated in these Terms or our Refund Policy.

14.2 Suspension or Termination by Backstage.cam. We may suspend, restrict, or terminate your account or access to the Platform, with or without notice, where we reasonably determine that:

(a) you have violated these Terms or any applicable Policies;

(b) you have violated applicable law or regulatory requirements;

(c) your account has been used for fraudulent, illegal, abusive, or unauthorized activity;

(d) you have provided false, inaccurate, or misleading information;

(e) your activity creates security, compliance, payment, chargeback, or fraud risk;

(f) suspension or termination is requested or required by a payment service provider, regulator, court, law enforcement authority, or other competent authority;

(g) your account has been inactive for an extended period; or

(h) such action is reasonably necessary to protect the Platform, its users, or Backstage.cam's legal, regulatory, or commercial interests.

14.3 Effect of Termination. Upon termination:

(a) your right to access the Platform ceases immediately;

(b) active subscriptions may be cancelled or disabled;

(c) access to purchased or subscription-based digital content may cease;

(d) we may retain data as required or permitted by law, our Privacy Policy, or legitimate business purposes;

(e) provisions that by their nature should survive termination will survive.

14.4 Fraud, Abuse, and Payment Disputes. In cases involving fraud, illegal activity, abuse, chargebacks, payment disputes, or serious violations of these Terms, Backstage.cam may suspend access, cancel transactions, refuse refunds, or take any other action permitted by law and payment processor requirements.

15. Cooperation with Authorities

15.1 Compliance with Legal Requests. Backstage.cam may cooperate with law enforcement authorities, regulators, and other competent authorities in connection with investigations of illegal activity, fraud, or violations of applicable laws.

15.2 Disclosure of Information. We may disclose user information, account data, content, and transaction records where required to comply with applicable law, legal process, or valid requests from competent authorities.

15.3 Reporting of Illegal Activity. Backstage.cam may report suspected illegal activity to relevant authorities where required or permitted under applicable laws.

16. Disclaimer of Warranties

16.1 General Disclaimer. The Platform is provided on an "as is" and "as available" basis, to the maximum extent permitted by applicable law.

16.2 Scope of Disclaimer. To the maximum extent permitted by applicable law, Backstage.cam disclaims all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

16.3 Platform Availability. Backstage.cam does not guarantee that the Platform will be uninterrupted, secure, or error-free, or that any defects will be corrected.

16.4 Content and Service Disclaimer. Backstage.cam does not guarantee that content or services will meet individual user expectations or preferences.

17. Limitation of Liability

17.1 Scope of Liability. To the maximum extent permitted by applicable law, Backstage.cam and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, data, or other intangible losses.

17.2 Liability Cap. To the maximum extent permitted by applicable law, Backstage.cam's total aggregate liability for any claims arising out of or in connection with these Terms or your use of the Platform shall not exceed the greater of:

(a) the total amounts paid by you to Backstage.cam in the twelve (12) months preceding the claim; or

(b) USD 100 (or equivalent in local currency, where required by law)

17.3 Non-Excludable Liability. Nothing in these Terms shall exclude or limit liability where such limitation or exclusion is not permitted under applicable law, including liability for fraud, willful misconduct, or gross negligence.

17.4 Application of Limitations. These limitations apply regardless of the legal theory of liability and even if Backstage.cam has been advised of the possibility of such damages.

18. Indemnification

You agree to indemnify, defend, and hold harmless Backstage.cam, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

(a) your use or misuse of the Platform;

(b) your violation of these Terms, the Policies, or applicable law;

(c) your unauthorized use of the Platform, its services, or its content;

(d) your infringement or violation of any third-party rights.

19. Dispute Resolution

19.1 Informal Resolution. Before filing any formal dispute, you agree to first contact us at disputes@backstage.cam and attempt to resolve the dispute informally for at least 30 days.

19.2 Governing Law. These Terms are governed by and construed in accordance with the laws of Luxembourg, without regard to conflict of law principles.

19.3 Jurisdiction. Subject to Section 19.4, any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of Luxembourg.

19.4 Consumer Rights. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under applicable mandatory consumer protection laws.

19.5 EU Online Dispute Resolution. If you are a consumer in the EU, you may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

20. General Provisions

20.1 Entire Agreement. These Terms, together with the Policies, constitute the entire agreement between you and Backstage.cam regarding the Platform and supersede all prior agreements.

20.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

20.3 Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

20.4 Assignment. You may not assign or transfer these Terms or your rights hereunder. We may assign these Terms without restriction.

20.5 Force Majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

20.6 No Agency. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Backstage.cam.

20.7 Language. These Terms are drafted in English. If translated, the English version prevails in case of conflict.

21. Contact Information
