1.1 Backstage.cam ("Backstage", "we", "us", or the "Service") is a digital content service that curates, licenses, and makes available digital media content from approved content providers. Backstage offers users access to such content through subscriptions and one-off paid access.
1.2 The Backstage.cam website, domain, software, brand, technical systems, and related service assets are owned, controlled, or administered by Influencestage Ltd, a company registered in Hong Kong under registration number 76319550, with its registered office at Room 1305, 13/F, Hollywood Centre, 233 Hollywood Road, Sheung Wan, Hong Kong. Backstage.cam may be operated for specific customer, product, territory, or payment flows by one or more licensed group operating or payment entities, including Influencestage Ltd, a company registered in Hong Kong under registration number 76319550, with its registered office at Room 1305, 13/F, Hollywood Centre, 233 Hollywood Road, Sheung Wan, Hong Kong, or another Backstage group operating entity identified at checkout, on your receipt or invoice, or in transaction-specific disclosures.
1.3 Backstage.cam acquires or licenses rights to digital content from approved content providers and provides access to such content through its service.
1.4 Backstage.cam is a curated digital content service. All content made available on the service is sourced, selected, and approved by Backstage.cam in accordance with its editorial standards and applicable legal and regulatory requirements. Content that does not meet these standards, including adult or sexually explicit material, is not accepted or distributed.
1.5 For any purchase or subscription, the applicable seller, customer-contracting entity, merchant of record, receipt or invoice issuer, refund owner, and chargeback owner will be the entity identified prior to completion of checkout, on the corresponding receipt or invoice, or in transaction-specific disclosures for that payment flow (the “Applicable Backstage Entity”).
1.6 Where these Terms refer to “Backstage,” “Backstage.cam,” “we,” “us,” or “our,” this means Influencestage Ltd and/or the Applicable Backstage Entity, depending on the context and the relevant service, transaction, data, or payment flow.
2.1 These Terms of Service ("Terms"), together with our Privacy Policy, Refund and Cancellation Policy, Cookie Policy, and any other policies referenced herein or made available through the Service (collectively, the "Policies"), govern your access to and use of the Service.
2.2 By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Policies.
2.3 If you do not agree to these Terms, you must not access or use the Service.
2.4 These Terms constitute a legally binding agreement between you and Influencestage Ltd for general access to and use of the Service, including account access, service functionality, software, brand, technical systems, content availability, and other non-transactional service matters. For any purchase or subscription, these Terms also constitute a legally binding agreement between you and the Applicable Backstage Entity for the relevant transaction or payment flow, including payment processing, receipt or invoice issuance, refunds, chargebacks, payment disputes, and related payment matters.
3.1 Eligibility
You must be legally capable of entering into binding agreements under the laws of your jurisdiction to access or use the Service.
3.2 Minimum Age
The Service may be accessed by individuals aged 13 to 17 only with the consent and supervision of a parent or legal guardian.
Features involving payments, subscriptions, or financial transactions are strictly limited to individuals aged 18 years or older.
3.3 Independent Content Providers and Commercial Counterparties
Individuals or entities that enter into commercial contractual arrangements with Influencestage Ltd in connection with the Backstage.cam service, including arrangements to provide licensed content, promotional services, or related marketing services (“Content Providers”), must complete a verification and onboarding process prior to providing any such content or services.
This process is mandatory and may include:
(a) Identity Verification: Submission of valid, unexpired government-issued photo identification (e.g., passport, national ID, or driver’s license);
(b) Age Verification: Confirmation that the individual is at least 18 years of age;
(c) Biometric Verification: Liveness or facial verification checks designed to prevent identity fraud, impersonation, or the use of manipulated or synthetic media;
(d) AML and Sanctions Screening: Screening against applicable global watchlists and compliance databases, including but not limited to sanctions lists (e.g., OFAC, UN, EU, HMT), politically exposed persons (PEP) databases, and adverse media sources;
(e) Third-Party Verification Providers: Use of secure, accredited third-party identity and compliance service providers.
Influencestage Ltd reserves the right to determine the scope and extent of verification required based on risk, legal and regulatory requirements, service safety requirements, and payment processor or banking partner obligations.
3.4 Record-Keeping and Verification Records
Influencestage Ltd maintains records of identity verification, onboarding, fraud-prevention, sanctions-screening, and related checks in accordance with applicable laws, regulatory requirements, payment processor requirements, contractual obligations, and its Privacy Policy.
Content Providers and other commercial counterparties acknowledge that such records may be retained for the period required or permitted by law, contract, payment processor requirements, banking partner requirements, fraud-prevention requirements, accounting requirements, or legitimate business purposes.
3.5 Additional Information and Ongoing Verification
Influencestage Ltd reserves the right, at its sole discretion, to:
(a) request additional identity, tax, or banking information;
(b) conduct re-verification at any time;
(c) apply enhanced due diligence measures for higher-risk profiles or activities;
(d) suspend or terminate relationships pending completion of verification or compliance checks;
(e) refuse to onboard or continue any contractual relationship with any individual or entity that does not meet applicable requirements.
3.6 Non-Compliance
If Influencestage Ltd and/or, where applicable in relation to a purchase, subscription, transaction, payment flow, refund, chargeback, or payment dispute, the relevant Applicable Backstage Entity determines that any user, Content Provider, or other commercial counterparty does not meet applicable eligibility, age, identity, verification, sanctions, fraud-prevention, payment, or compliance requirements, Influencestage Ltd and/or the relevant Applicable Backstage Entity may immediately suspend or terminate access to the Service, content, payment functionality, payments, payouts, or any related contractual relationship, and may take any additional action required or permitted by law, regulation, card network rules, banking partner requirements, or payment processor obligations.
3.7 Ongoing Monitoring
Backstage.cam may conduct ongoing monitoring of Service activity, account activity, transaction activity, payment activity, content-related activity, and business relationships for the purposes of fraud prevention, security, legal and regulatory requirements, payment security, Service safety, and risk management.
This may include periodic re-verification, transaction review, account review, payment review, sanctions or restricted-party screening, and review of activity patterns.
3.8 Cooperation
Content Providers and other relevant users agree to cooperate fully with reasonable requests from Influencestage Ltd, the relevant Applicable Backstage Entity where applicable, or their payment processing partners in connection with identity verification, age verification, compliance reviews, fraud prevention, and legal, regulatory, or payment processor obligations.
4.1 We may modify these Terms at any time at our discretion. For material changes, we will provide at least 15 days' prior notice by email, through the Service, or by prominent notice on the Service before such changes take effect, except where changes are required by law, required by a payment processor or banking partner, relate to new features, or are necessary for security, fraud prevention, or risk-management reasons.
4.2 Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the changes take effect.
4.3 By using the Service, you consent to receive communications from us electronically, including notices regarding your account, transactions, payments, subscriptions, refunds, chargebacks, support requests, and changes to our Terms or Policies. Such communications satisfy any legal requirement for written notice.
5.1 You must provide accurate, current, and complete information when creating an account and keep such information up to date. Providing false, misleading, or fraudulent information is grounds for immediate account termination.
5.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. You must notify us immediately of any unauthorized access or security breach.
5.3 Accounts are personal and non-transferable. You may not sell, rent, sublicense, share, or allow third-party access to your account.
5.4 You may maintain only one account. Creating multiple accounts to circumvent restrictions, suspensions, bans, verification requirements, payment checks, or security measures is strictly prohibited.
5.5 For users under the age of 18, a parent or legal guardian must consent to and supervise the use of the account and is responsible for all activity conducted through it.
5.6 We reserve the right to suspend, restrict, disable, or terminate any account, username, or identifier at our discretion, including for violations of these Terms, the Policies, or applicable law.
6.1 Service Functionality
The Service enables users to:
(a) create and manage personal accounts;
(b) access and view digital content made available by Backstage.cam;
(c) purchase subscription-based or one-off paid access to such content, where eligible.
6.2 Interactive Features
The Service may include interactive features, including messaging, profile notifications, recommendations, engagement tools, customer support features, and other communications associated with Content Provider profiles. These features may be managed, automated, or assisted by Backstage.cam or AI-assisted tools.
6.3 Content Sourcing and Control
All content made available on the Service is sourced from approved Content Providers under separate commercial agreements with Influencestage Ltd. All content made available through the Service is selected, reviewed, approved, and controlled by Influencestage Ltd before being made available to users.
6.4 Content Selection and Editorial Standards
Influencestage Ltd operates a controlled content selection process. Content is only made available where it complies with Influencestage Ltd’s editorial standards, as well as applicable legal, regulatory, payment processor, and risk-management requirements. Content that contains nudity, sexual acts, explicit sexual conduct, solicitation of sexual services, or material that Influencestage Ltd determines to be adult-oriented, sexually explicit, or inconsistent with its content standards is prohibited and will be rejected, restricted, or otherwise acted upon.
6.5 Content Availability
Influencestage Ltd may modify, remove, suspend, discontinue, or restrict access to content where necessary or appropriate to comply with applicable laws, regulations, payment processor requirements, rights-related concerns, risk-management requirements, or operational needs.
7.1 Paid Access to Digital Content
Backstage offers subscription-based and one-off paid access to digital content made available through the Service.
All purchases and subscriptions are made directly with the Applicable Backstage Entity. For each purchase or subscription, the Applicable Backstage Entity is the seller of record and merchant of record, as identified in the applicable checkout flow, on the corresponding receipt or invoice, or in transaction-specific disclosures.
7.2 Nature of the Service
Subscriptions and purchases provide users with access to digital content made available through the Service.
Access is granted for the applicable subscription period or on a per-content basis, as indicated at the time of purchase.
7.3 Content Availability
Influencestage Ltd determines, at its sole discretion, the content made available on the Service and does not guarantee the continued availability of any specific content.
7.4 Subscription Terms
(a) Subscriptions are billed on a recurring basis (e.g., monthly) unless cancelled prior to the renewal date.
(b) By subscribing, you authorize the Applicable Backstage Entity and its payment processor to charge your selected payment method for each billing period until cancellation.
(c) Subscription fees are charged in advance at the beginning of each billing period.
(d) You may cancel your subscription at any time through your account settings or any other cancellation method made available through the Service. Cancellation takes effect at the end of the current billing period.
7.5 Digital Content Delivery
Digital content is made available immediately upon purchase or activation of a subscription, unless otherwise specified in the Service or applicable checkout flow.
8.1 Payment Processing
Payments for purchases and subscriptions made through the Service are processed by third-party payment service providers on behalf of the relevant Applicable Backstage Entity. Payment processing is subject to the terms, security standards, and compliance requirements of the applicable payment service provider.
Influencestage Ltd, the Applicable Backstage Entity, and their service providers do not store full payment card numbers or full bank account details, except where such information is securely handled by an authorized payment service provider. Influencestage Ltd and/or the relevant Applicable Backstage Entity may add, remove, or change payment service providers at any time for legal, regulatory, compliance, risk-management, operational, or commercial reasons.
8.2 Accepted Payment Methods
The accepted payment methods are those displayed in the applicable checkout flow at the time of purchase or subscription. Available payment methods may vary by country, currency, product, payment flow, Applicable Backstage Entity, and payment service provider, and may be added, removed, or modified at any time.
8.3 Pricing and Billing
All prices are displayed in the applicable checkout flow at the time of purchase and may include applicable taxes, fees, currency conversion, or currency adjustments where required or permitted by law.
By completing a purchase, subscription, or one-off paid access transaction, you authorize the relevant Applicable Backstage Entity, directly or through its payment processor, to charge your selected payment method for the applicable amount.
For each purchase, subscription, one-off paid access transaction, or other paid access product, the Applicable Backstage Entity is the seller of record and merchant of record for that transaction, as identified in the applicable checkout flow, on the corresponding receipt or invoice, or in transaction-specific disclosures.
Influencestage Ltd and/or the relevant Applicable Backstage Entity may adjust pricing where necessary or appropriate to reflect applicable taxes, fees, currency fluctuations, currency conversion, legal requirements, payment processor requirements, or operational requirements.
8.4 Subscriptions and Auto-Renewal
(a) Subscriptions are billed on a recurring basis, such as monthly or as otherwise displayed in the applicable checkout flow, unless cancelled before the applicable renewal date.
(b) By subscribing, you authorize the relevant Applicable Backstage Entity, directly or through its payment processor, to automatically charge your selected payment method at the start of each billing period until cancellation.
(c) Subscription fees are billed in advance.
(d) You may cancel your subscription at any time through your account settings or any other cancellation method made available through the Service. Cancellation takes effect at the end of the current billing period, unless otherwise stated in the applicable checkout flow or required by law.
8.5 Digital Content and Delivery
Subscriptions and one-off paid access made through the Service provide access to digital content. Access is granted immediately upon purchase, subscription activation, or completion of the applicable payment flow, unless otherwise specified in the Service or applicable checkout flow.
8.6 Refunds
(a) Customer Satisfaction
Backstage aims to provide a high level of customer satisfaction. If you experience a technical issue, billing error, access issue, or other legitimate concern with a purchase, subscription, or one-off paid access, you should contact Backstage support so the issue can be reviewed and resolved.
(b) Refunds and Credits
The relevant Applicable Backstage Entity may provide a refund or credit where appropriate, including in cases of technical issues, billing errors, duplicate charges, unauthorized charges, access issues, or other legitimate customer concerns. Refunds remain subject to applicable law, payment processor requirements, and fraud-prevention checks.
(c) Abuse, Fraud, or Chargebacks
Refunds may be refused where the relevant Applicable Backstage Entity or Influencestage Ltd determines that a request is fraudulent, abusive, made in bad faith, or connected to misuse of the Service, chargeback abuse, payment misuse or violation of these Terms.
(d) Refund Method
Any approved refund will be issued to the original payment method, unless otherwise required by law or determined by the relevant Applicable Backstage Entity or payment service provider.
8.7 Chargebacks and Payment Disputes
The relevant Applicable Backstage Entity reserves the right to investigate, contest, and respond to any chargeback, payment dispute, reversal, or refund request initiated through a payment provider, card network, bank, or financial institution.
Influencestage Ltd may separately suspend, restrict, or terminate access to the Service, account functionality, or content access where it determines that a chargeback, payment dispute, reversal, or refund request is fraudulent, abusive, made in bad faith, or connected to misuse of the Service or violation of these Terms.
8.8 Fraud Prevention and Transaction Monitoring
Influencestage Ltd and/or the relevant Applicable Backstage Entity may monitor transactions, payment activity, account activity, and use of the Service for fraud prevention, payment security, legal requirements, Service safety, and risk-management purposes.
The relevant Applicable Backstage Entity may decline, delay, suspend, or cancel transactions where necessary or appropriate to comply with applicable laws, regulations, card network rules, banking partner requirements, payment processor requirements, or requirements applicable to the Applicable Backstage Entity.
Influencestage Ltd may separately suspend, restrict, or terminate access to the Service, account functionality, or content access where necessary or appropriate for fraud prevention, compliance, platform safety, risk management, or violation of these Terms.
8.9 Billing Descriptor
Transactions may appear on your payment statement as “BACKSTAGE.CAM,” “Backstage,” the name of the relevant Applicable Backstage Entity, or another descriptor associated with the applicable payment flow. Billing descriptors may vary depending on the country, currency, payment method, payment service provider, or Applicable Backstage Entity involved in the transaction.
8.10 Payment Rules and Requirements
Payments, subscriptions, one-off paid access, refunds, chargebacks, and related transaction activity are subject to applicable payment network rules, financial regulations, banking partner requirements, and payment processor requirements. If any such rules or requirements impose stricter obligations than these Terms for a transaction or payment flow, those rules or requirements shall apply to the extent required.
9.1 General Rule
You may not use the Service in any manner that is unlawful, fraudulent, abusive, or intended to circumvent, manipulate, or misuse the Service, payment functionality, refund process, chargeback process, or any related transaction flow.
9.2 Circumvention of Service Systems
You may not attempt to bypass, circumvent, manipulate, or interfere with the Service’s systems, including payment systems, subscription mechanisms, access controls, security features, or content-access restrictions. This includes any attempt to access content without authorization.
9.3 Payment Fraud and Abuse
You may not:
(a) use stolen, unauthorized, or third-party payment methods without proper authorization;
(b) initiate chargebacks, payment disputes, refund requests, or reversals in a fraudulent, abusive, or bad-faith manner;
(c) test, probe, validate, or attempt to use payment credentials without authorization; or
(d) create or use multiple accounts to evade restrictions, suspensions, bans, verification requirements, or security measures.
9.4 Unauthorized Use of Content or Services
You may not access, distribute, reproduce, share, or otherwise use any content made available through the Service in any manner that is unauthorized, unlawful, or in violation of these Terms.
9.5 Illegal or Prohibited Activities
You may not use the Service in connection with any unlawful activity or to engage in conduct that violates applicable laws, regulations, payment processor requirements, or these Terms.
9.6 Monitoring and Enforcement
Influencestage Ltd may monitor activity on the Service for the purposes of fraud prevention, security, risk management, and enforcement of these Terms.
Violations of this Section may result in suspension or termination of your account, restriction of access to the Service or content, cancellation of transactions by the relevant Applicable Backstage Entity, or other actions as necessary to protect the Service, users, payment functionality, and related business relationships.
Influencestage Ltd and/or the relevant Applicable Backstage Entity may report suspected unlawful, fraudulent, or abusive activity to relevant authorities, payment service providers, banks, card networks, or other appropriate third parties where required or permitted.
10.1 Sanctions and Restricted Persons
Influencestage Ltd and the relevant Applicable Backstage Entity comply with applicable economic sanctions and restrictions relating to restricted persons, restricted territories, restricted transactions, blocked assets, and payment or banking restrictions, including those administered or enforced by the U.S. Office of Foreign Assets Control (OFAC), the European Union, the United Kingdom, the United Nations, and any other authority applicable to the Service or the relevant transaction, payment flow, or business relationship.
You represent and warrant that you are not:
(a) located in, organized under the laws of, or ordinarily resident in any country, region, or territory subject to comprehensive sanctions or similar restrictions applicable to the Service or the relevant transaction;
(b) identified on, or acting on behalf of any person or entity identified on, any applicable sanctions, restricted-party, denied-party, blocked-person, or similar list; or
(c) owned or controlled by, or acting for or on behalf of, any sanctioned, restricted, denied, or blocked person or entity.
10.2 Geographic Availability
The Service may not be available in all jurisdictions. Influencestage Ltd and/or the relevant Applicable Backstage Entity reserve the right to restrict access to the Service, content, purchases, subscriptions, one-off paid access, or payment functionality from certain countries or regions based on legal, regulatory, sanctions, payment processor, banking, or risk considerations.
11.1 Ownership and Licensing of Service Content
All content and materials made available through the Service, including digital media, text, graphics, interfaces, software elements, branding, and other materials, are owned by, licensed to, or otherwise authorized for use by Influencestage Ltd or its approved content providers. Such content and materials are protected by applicable intellectual property laws, including copyright, trademark, and related rights.
11.2 Limited Access Rights
Purchases, subscriptions, and one-off paid access provide access to digital content only. No purchase, subscription, or one-off paid access transfers ownership of any content or grants any intellectual property rights, except for the limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and view the applicable content through the Service for personal, non-commercial use in accordance with these Terms.
11.3 Restrictions on Use
Users may not, without prior written authorization from Influencestage Ltd:
(a) reproduce, distribute, publish, share, transmit, modify, adapt, or create derivative works from any content, except as expressly permitted through the Service for personal, non-commercial use;
(b) publicly display, perform, transmit, publish, share, or make content available outside the Service;
(c) sell, license, sublicense, rent, assign, transfer, or otherwise exploit content for commercial purposes; or
(d) scrape, extract, bypass access controls, or otherwise obtain or use content by unauthorized means.
11.4 Trademarks and Service Materials
The Backstage.cam name, logo, trademarks, service marks, branding, visual identity, user interface, design, software, functionality, and other Service materials are owned by, licensed to, or otherwise authorized for use by Influencestage Ltd, and may not be used without prior written authorization from Influencestage Ltd.
11.5 Intellectual Property Complaints
Influencestage Ltd respects intellectual property rights and takes allegations of infringement seriously.
If you believe that any content made available through the Service infringes your rights, you may contact us at legal@backstage.cam with sufficient information to identify the content and describe your claim.
Influencestage Ltd will review such notices and take appropriate action where required or appropriate in accordance with applicable laws.
11.6 Enforcement
Influencestage Ltd reserves the right to remove, suspend, or restrict access to content that is alleged to infringe intellectual property rights, or that Influencestage Ltd reasonably determines may violate applicable law, third-party rights, or these Terms. Influencestage Ltd may also take any action required or appropriate to comply with applicable law.
12.1 Privacy Policy
The collection, use, storage, sharing, and other processing of personal data in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference.
12.2 Use of Personal Data
By using the Service, you acknowledge that personal data may be collected, used, stored, shared, transferred, and otherwise processed as described in the Privacy Policy and as necessary to provide the Service, process purchases and subscriptions, verify eligibility, prevent fraud, maintain security, provide support, enforce these Terms, and meet applicable legal, regulatory, tax, accounting, banking, or payment processor requirements.
12.3 Sharing of Personal Data
Personal data may be shared with Influencestage Ltd, the relevant Applicable Backstage Entity, Backstage group companies, payment processors, banks, identity-verification providers, age-verification providers, fraud-prevention providers, hosting and technical service providers, customer support providers, professional advisers, law enforcement, regulators, courts, public authorities, or other third parties where described in the Privacy Policy, required or permitted by law, necessary for the Service, or necessary to protect users, the public, the Service, transactions, or business relationships.
12.4 Backstage Group Entities
Influencestage Ltd operates and administers the Website and the Service. The relevant Applicable Backstage Entity may be involved in processing payments, issuing receipts or invoices, handling refunds, responding to payment disputes or chargebacks, and related transaction matters. Other Backstage group entities and service providers may support the Service where necessary for support, security, fraud prevention, verification, legal, regulatory, tax, accounting, banking, or payment processor requirements.
13.1 The Service may contain links to or integrations with third-party services, including payment processors, identity verification providers, age-verification providers, fraud-prevention providers, analytics providers, and customer support tools.
13.2 Your use of third-party services may be subject to their respective terms, policies, and privacy notices. Influencestage Ltd and the relevant Applicable Backstage Entity are not responsible for third-party content, practices, services, or availability, except where required by applicable law.
13.3 Third-party payment processors may have additional terms, security checks, or requirements that apply to transactions, payment methods, refunds, chargebacks, or payment disputes.
14.1 Termination by You
You may close your account at any time by contacting Backstage support. If you close your account while you have an active subscription, future renewals will be cancelled.
Account closure does not affect obligations incurred before closure, completed transactions, pending payments, refunds, chargebacks, payment disputes, or any rights and obligations that are intended to survive termination. Refunds, where applicable, will be handled in accordance with our Refund Policy and applicable law.
14.2 Suspension or Termination by Influencestage Ltd
Influencestage Ltd may suspend, restrict, or terminate your account or access to the Service, with or without notice, where it reasonably determines that:
(a) you have violated these Terms or any applicable Policies;
(b) you have violated applicable law or regulatory requirements;
(c) your account has been used for fraudulent, illegal, abusive, or unauthorized activity;
(d) you have provided false, inaccurate, or misleading information;
(e) your activity creates security, payment, chargeback, fraud, legal, regulatory, or risk concerns;
(f) suspension or termination is requested or required by a payment service provider, regulator, court, law enforcement authority, or other competent authority;
(g) your account has been inactive for an extended period; or
(h) such action is reasonably necessary to protect the Service, its users, Influencestage Ltd’s legal, regulatory, security, risk-management, or commercial interests, or the legal, regulatory, payment, chargeback, fraud-prevention, or commercial interests of the relevant Applicable Backstage Entity.
14.3 Effect of Termination
Upon termination:
(a) your right to access and use the Service may cease immediately;
(b) active subscriptions may be cancelled or disabled;
(c) access to purchased, subscription-based, or other paid digital content may be suspended, restricted, or terminated where the account is suspended or terminated due to fraud, misuse, breach of these Terms, payment failure, chargeback abuse, legal requirements, payment processor requirements, or other risk-related reasons;
(d) Influencestage Ltd and/or the relevant Applicable Backstage Entity may retain data as required or permitted by law, the Privacy Policy, payment processor requirements, fraud-prevention requirements, accounting requirements, or legitimate business purposes; and
(e) provisions that by their nature should survive termination will survive.
14.4 Fraud, Abuse, and Payment Disputes
In cases involving fraud, illegal activity, abuse, chargebacks, payment disputes, or serious violations of these Terms, Influencestage Ltd may suspend, restrict, or terminate access to the Service, account functionality, or content access, and the relevant Applicable Backstage Entity may cancel transactions, refuse refunds, contest chargebacks or payment disputes, or take other transaction-related action permitted by law, payment network rules, banking partner requirements, or payment processor requirements.
15.1 Legal Requests and Investigations
Influencestage Ltd and/or the relevant Applicable Backstage Entity may cooperate with law enforcement authorities, regulators, payment service providers, banks, financial institutions, card networks, courts, and other competent authorities in connection with investigations, legal requests, fraud prevention, payment disputes, chargebacks, illegal activity, or violations of applicable laws or these Terms.
15.2 Disclosure of Information
Influencestage Ltd and/or the relevant Applicable Backstage Entity may disclose user information, account data, content-related information, and transaction records where required or permitted by applicable law, legal process, payment processor requirements, or valid requests from competent authorities.
15.3 Reporting of Illegal Activity
Influencestage Ltd and/or the relevant Applicable Backstage Entity may report suspected illegal, fraudulent, or abusive activity to relevant authorities, payment service providers, banks, financial institutions, card networks, or other appropriate third parties where required or permitted under applicable law.
16.1 General Disclaimer
The Service is provided on an “as is” and “as available” basis, to the maximum extent permitted by applicable law.
16.2 Scope of Disclaimer
To the maximum extent permitted by applicable law, Influencestage Ltd and the relevant Applicable Backstage Entity disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or uninterrupted operation.
16.3 Service Availability
Influencestage Ltd does not guarantee that the Service will be uninterrupted, secure, error-free, or available at all times, or that any defects will be corrected.
16.4 Content and Service Disclaimer
Influencestage Ltd does not guarantee that any content, feature, or service will meet individual user expectations, preferences, or requirements.
17.1 Scope of Liability
To the maximum extent permitted by applicable law, Influencestage Ltd, the relevant Applicable Backstage Entity, their affiliated group entities, and their respective officers, directors, employees, contractors, agents, service providers, and representatives (collectively, the “Backstage Parties”) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, content, business opportunity, or other intangible losses, arising out of or in connection with these Terms, the Service, any content, any purchase or subscription, or any transaction or payment flow.
17.2 Liability Cap
To the maximum extent permitted by applicable law, the total aggregate liability of the Backstage Parties for any claims arising out of or in connection with these Terms, the Service, any content, any purchase or subscription, or any transaction or payment flow shall not exceed the greater of:
(a) the total amounts paid by you to the relevant Applicable Backstage Entity through the Service during the twelve (12) months preceding the event giving rise to the claim; or
(b) USD 100, or the equivalent amount in local currency where required by applicable law.
17.3 Non-Excludable Liability
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any mandatory consumer rights that cannot lawfully be waived.
17.4 Application of Limitations
The limitations in this Section apply regardless of the legal theory of liability, whether based in contract, tort, negligence, strict liability, statute, or otherwise, and even if any Backstage Party has been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Influencestage Ltd, the relevant Applicable Backstage Entity, their affiliated group entities, and their respective officers, directors, employees, contractors, agents, service providers, and representatives (collectively, the “Backstage Indemnified Parties”) from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to:
(a) your use or misuse of the Service;
(b) your violation of these Terms, any applicable Policies, or applicable law;
(c) your unauthorized use of the Service, any content, payment functionality, or account functionality;
(d) your infringement, misappropriation, or violation of any intellectual property, privacy, publicity, contractual, or other third-party rights; or
(e) any fraudulent, abusive, unauthorized, or bad-faith payment activity, refund request, chargeback, payment dispute, or reversal.
19.1 Informal Resolution
Before filing any formal dispute, you agree to first contact us at disputes@backstage.cam and attempt to resolve the dispute informally for at least thirty (30) days, unless a shorter period is required by applicable law or urgent legal action is reasonably necessary.
19.2 Governing Law
These Terms are governed by and construed in accordance with the laws of Hong Kong in relation to general access to and use of the Service, accounts, content, intellectual property, Service operation, and other non-transactional Service matters, without regard to conflict of law principles.
For any purchase, subscription, one-off paid access, payment, refund, chargeback, payment dispute, receipt, invoice, or other transaction-related matter, the governing law may depend on the relevant Applicable Backstage Entity identified in the applicable checkout flow, on the corresponding receipt or invoice, or in transaction-specific disclosures. Unless otherwise stated in the applicable checkout flow or transaction-specific disclosures:
(a) if the Applicable Backstage Entity is Influencestage Ltd, the relevant transaction-related matters are governed by and construed in accordance with the laws of Hong Kong, without regard to conflict of law principles; and
(b) if the Applicable Backstage Entity is Wild SARL, the relevant transaction-related matters are governed by and construed in accordance with the laws of Luxembourg, without regard to conflict of law principles.
Nothing in this Section limits any mandatory consumer protection rights or other non-waivable rights that apply under the laws of your country of residence.
19.3 Jurisdiction
Subject to Section 19.4 and any mandatory rights available to consumers under applicable law, disputes relating to general access to and use of the Service, accounts, content, intellectual property, Service operation, or other non-transactional Service matters shall be subject to the exclusive jurisdiction of the competent courts of Hong Kong.
For any purchase, subscription, one-off paid access, payment, refund, chargeback, payment dispute, receipt, invoice, or other transaction-related matter, jurisdiction may depend on the relevant Applicable Backstage Entity identified in the applicable checkout flow, on the corresponding receipt or invoice, or in transaction-specific disclosures. Unless otherwise stated in the applicable checkout flow or transaction-specific disclosures:
(a) if the Applicable Backstage Entity is Influencestage Ltd, the relevant transaction-related disputes shall be subject to the exclusive jurisdiction of the competent courts of Hong Kong; and
(b) if the Applicable Backstage Entity is Wild SARL, the relevant transaction-related disputes shall be subject to the exclusive jurisdiction of the competent courts of Luxembourg City, Luxembourg.
Nothing in this Section limits any mandatory consumer protection rights, local court rights, or other non-waivable rights that apply under the laws of your country of residence.
19.4 Consumer Rights
If you are a consumer resident in the European Union, European Economic Area, or United Kingdom, you may have the right to bring proceedings in the courts of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under applicable mandatory consumer protection laws.
20.1 Entire Agreement
These Terms, together with the Policies, constitute the entire agreement between you, Influencestage Ltd, and, where applicable for any purchase, subscription, one-off paid access, payment, refund, chargeback, or other transaction-related matter, the relevant Applicable Backstage Entity, regarding the Service, and supersede all prior agreements or understandings relating to the Service.
20.2 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.
20.3 Waiver
The failure of Influencestage Ltd or the relevant Applicable Backstage Entity to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
20.4 Assignment
You may not assign or transfer these Terms or any rights or obligations under these Terms without prior written consent from Influencestage Ltd. Influencestage Ltd and/or the relevant Applicable Backstage Entity may assign or transfer these Terms, in whole or in part, to an affiliated entity, successor, acquirer, reorganized entity, or other operating or payment entity, where permitted by applicable law.
20.5 Force Majeure
Influencestage Ltd and the relevant Applicable Backstage Entity shall not be liable for any failure or delay in performance due to circumstances beyond their reasonable control.
20.6 No Agency
Nothing in these Terms creates any partnership, joint venture, agency, employment, fiduciary, or franchise relationship between you and Influencestage Ltd, the relevant Applicable Backstage Entity, or any affiliated entity.
20.7 Language
These Terms are drafted in English. If these Terms are translated into another language, the English version will prevail in the event of any conflict, except where prohibited by applicable law.
